What is the BEST way to track a dead beat dad when you've already gone to the county child support services? My child resides in California and the so called dad AKA sperm donor now lives in Florida which I had to find out through the medical insurance company - info was given to me by mistake. Not completely but enough for me to know he's moved out of the state he originally lived. I have been paying arrears for years and the (2) children are grown with children of their own. She has agreed to have me stop paying any longer. How do I apply for sole legal and physical custody of my child in Osceola County, Florida? Please read details? My ex-husband and I were divorced in California and were granted 50/50 custody by the court in 2007. Our divorce was official in 2008. I have since gained permission to move to Florida (April 2008). I have now been living in Florida for over a year and have been the sole sole provider and decision-maker for my 5 year old. My ex was never given an order to pay child support, but has been sending me 1/2 of my child's monthly tuition every month for her private school. He has not paid for the last 3 months and hardly ever sees my child. How do I go about going to court now that I am a Florida resident? I already do everything that the sole parent does, legally and physically. How do I make it official? Also, our custody deal was kind of shady because of our "mediator" in California. There, they believe that unless the other parent is a complete crackhead then you should have 50/50 custody. I have been the sole caretaker of my child since birth. I kept track on a calendar of all the days I had my child for the mediator and my lawyer ( which was equal to more than 75%) and the mediator said, "It's great that he allows you extra parenting time on his days." What a fricken load of BS! How about, "Wow, you really don't take care of your child, so she should just live with her mother." Even when my ex and I separated in 2006, I took full responsibility for my child and kept my child with me (with no support from my ex). He has always been pretty much a deadbeat when it comes to parenting. He has not done anything illegal, but does not give my child the support needed...even though he has a decent guaranteed paycheck in the military. He does not agree, so I know I will have to go to court. I am pretty proficient with paperwork after spending a lot of time in the military doing legal work, so I would like to get a jump start on the actual paperwork myself. I found with my divorce that when I filled out all the paperwork by myself and then took it to a lawyer for review, I saved a ton of money. All right, enough bashing. I got married in Aviano, Italy while I was in the military. Got pregnant, and we got stationed in California. After going to war for my country in Iraq and Afghanistan while my husband stayed home behind his cushy military office chair, I came home to someone who said things to me like, "Don't try to hold the baby, she doesn't love y ou anyways because you left her." Now, the whole 9 months I was away my mother had my child in another state for 4 months, his mother had her in a different state for 4 months, and my ex actually had her for the month just before I came home. All this because he couldn't take care of her between all of his partying and compulsive gambling. I was making extra money while I was away for combat pay and payed ALL the bills, not to mention ordering baby formula, toys, bath soap, and clothes online for my child while I was away because he couldn't bring his lazy butt to do it himself. Then I got out of the military to take care of our child better because my deployments were too much for HIM to handle. So I became a full-time student, held a full-time job, and was a full-time mom. During this time, my ex would leave from work on a Friday afternoon, head to the casino, and we wouldn't see him come home until 8 or 9 am Saturday morning. When I finally confronted him, I got pushed down the stairs in front our then 2 year old. The time after that, I ended up with a black eye from him head-butting me while I was holding our child. So I tried to call the cops and he grabs the phone from me and tells the cops I'm crazy and that I HIT HIM! The cops got there just as I was packing up all of mine and my child's things and told him he was full of crap. They stayed there until I packed everything, and I got my own apartment that day. He agreed to let me come to Florida when I had a huge job opportunity here. I have since been laid off. Javier, that's great that things worked out for you...and if my ex was involved in my daughter's life I would be more than happy to let him be a part of it. However, I had a father just like him who beat the crap out of my mom, but never so much as spanked me. It's still not healthy. I have done everything to accomodate him since I moved. I have allowed my child to go back to California on MY DIME to see him when she didn't have school. I video tape her and take pictures and she talks to him more than 3 times a week. I have made sure she would be available to him whenever she is not in school, but he does not always take the opportunity. The only time he comes to see her is when the military puts him in a class in Orlando so he doesn't have to pay for it. Longbrownhair, I'm not asking for tuition payments. HE insisted that she goes to private school because he doesn't trust public schools. And the 1/2 tuition payment he makes monthly is about $300 LESS than what he would pay monthly in child support! If you would have read the rest of the details, you would see that I have made her as available as possible to him and that HE WILLINGLY let her move. You would have also read that he is abusive and a compulsive gambler. That is a great life for a kid, isn't it? She also has a father-figure in her life which my ex is fine with...he has been with me and around my daughter since she was 2 1/2. I grew up in the same situation that my daughter is going through now. I know what it's like without hearing about what some left-wing liberal psychologist has to say. I went through the experience at the same age as her, and I was not damaged by it. Once I was a teen and tried to hang out with my dad, I realized that he really was a deadbeat.
How to get child support office to review your case? my husbands child support comes directly out of his check and is to be paid to Wakulla county florida then disbursed, the problem is both children are in their 20's still paying 600.00 for one in college, we do not owe child support anymore wakulla county shows that but Tallahassee dept of revenue shows we owe over 24000.00 i have requested proof and sent them letters showing what wakulla showed where it is actually paid and get no response what steps should i take to stop this it is killing us? How do I enforce a child support order? (Interstate order)? I live in Mississippi and my ex-husband lives in Hillsborough County, Florida. He has been gone and has not seen his daughter since September 2006. I have a court order that states that he needs to pay $210 a month plus an additional $100 for arreages. This court order was created in 2007 and our divorce was finalized in 2008. I spoke with my case worker in Mississippi and she said that the amount could not be changed to reflect the additional year of 2008 in the arrearages. Mississippi has turned the case over to Florida, but still, NO RESULTS!!!!! When I spoke with child support in Florida, they said it could take up to a year. I am working 4 jobs and it is not fair to me or my daughter. What can I do, I am at my wit's end. I just can't continue to do this much longer. Thanks for your responses and God Bless!

Can someone please advise me on how to collect child support? My husband's ex-wife left his 2 small children on our doorstep 12 years ago when they were only 3 and 4 1/2 years old. The court custody papers say that my husband has sole custody and in addition to the support payments his ex must pay, she must also pay for 1/2 of all doctor bills (both kids are insulin dependent diabetics which is a very expensive disease). TX Child Support Revisement served to me-custodial parent. He made False Allegations & trying to stop paying!!? Hello everyone, Ok, in Feb 09' my sons father ( we were never married ) & I settled at mediation after I filed for child support at Attorney General office -Texas. The order gave him visitation rights for every other weekend. he worked offshore for many weeks to months at a time and rarely saw him living 5 miles apart. I as custodial parent had No Geographical Restrictions. So, when I was offered a job in Florida, I leaped with faith and moved with my son. I abided by all the instructions given by Attorney Generals office, changing employer info & changed of residence info to state case registry and attorney general office. I sent him a certified letter stating that I was moving to Florida, in which he received prior to me knowing my actual physical address since i was unsure if I got the place I was looking into. So the certified letter just said the city & states I was moving to. Yet, once it was confirmed I got the place I wrote it down for him, along with my employer, on a piece of paper while I went to his home to let him visit with my son. Now he has used that against me stating that I never gave him the address of where I was living. Which is false because he knows the address, my employer address and telephone #, and my sons daycare info.It was a quick move so I could give much notice but I did as much as I could with the time allowed. He is claiming that he doesnt know if I carry insurance for our son since he is ordered to pay for the insurance, yet I gave him the original insurance card & I use an old issued one. He is throwing so many allegations, from me being intimate with someone else, to talking bad about him in front of our son, to consuming alchohol & using drugs. I am barely getting settled in Florida & have a 3 year old, how can I date? Either way we arent together, so I can never move on & get involved in a relationship? I have no reason to talk bad about him in front of my son, since he is never around nor calls so I have nothing to say about him! The big whoop is that do not even drink! I There is so much more but my main concern is that I opened a case in Florida for child support & it is still in the process. State of Tx recommended I opened a case in Florida since I resided there so if we had to go to court he would have to go to Florida versus me going to Texas. Since he complained about the drive and never offered to go to Florida, I came to visit family for my sons birthday and allowed my son to stay the night with his father since we were in town & he hadn't seen him. When I go to retrieve him, that is when they give me these legal forms for modification of our child support order! It hurst because I was trying to be kind and let my son see his father because i want him so much to be a part of my sons life since I did not have my father in mine. Yet, he does this. He is selfish and a very sneaky con, has a way withwords and I have always been threatened by him since he financially is set, he makes 4 times as much as me yet is never in town, works offshore months at a time! How long can I delay this since I live out of town & just started a new job in Florida ( a big part of the reason why I moved) and I cannot risk taking off work. How can I defend myself? Through Accurint.com, I've found his social security number and address and home telephone number. He resides in Edgewater, Volusia County, FL. I reside in Buffalo, Erie County, NY. and I am a 21-year-old male university student. My mother and I have not received any child support from him at all. He left when I was born and my mother did not know his social security number, just his previous address and that he moved to the state of Florida. I believe that he will have to submit to a paternity test in order to prove that he is indeed my father. How can I go about ordering this via court? I have just filed for CHILD SUPPORT, Can anyone share the process with me? I just filed for Child Support, my ex is living in Florida i am in Michigan. The Child was born in Oakland County Michigan, so ive spoke to a child support specialist and he found a address for him in Florida and said he is forwarding my info over the Prosecuting attorney. Now once the PA has it what going on from there. I mean i know my ex don't have the $$$$, nor the $$$ to come up here to court. Best way to request a judge to issue a bench warrant? (Palm Beach County, FL):? Ex is going to court for FTA. Original appearance was required for suspended driver's license. License was suspended for failure to pay support. Apparently child support docs were not listed to require a warrant if my ex was contempt. He went to jail 2 days ago for the failure to appear and will hopefully show up for the next scheduled court date. Is there a way to submit a request to the judge for a bench warrant to be issued once he appears before the judge? And is this appropriate? Is seems that the suspended license does not truly enforce the support payer to pay their unpaid support... Note: Court ordered support is issued from a different Florida county. Child support modification help needed!!!? My finace and I were living in Florida about a year ago. We have a child together and we are now living in Missouri. While we were still in florida he finalized his divorce and started paying around 450 dollars a month in child support for one child age 11. We moved to Missouri back to my parents house because we werent able to afford that payment and the cost of living in Orlando. So, my fiance got a job making around 12 dollars and hr, about 200 less a month than before we moved to missouri and still paid the 450 dollars a month. Now he has been laid off from that job as of a few days ago. He was able to scramble up a job only paying 9 dollars an hour for the time being. There is no way we can keep up with that payment. His ex wife quit her job over the summer that paid over 20 dollars an hour to have a baby with her new husband so she is not working at all as far as I know. I know that Florida is still in charge of the child support modification since it was established there, BUT my questions are , how do we attend any kind of court hearing to have it modified if we cant afford to fly down there? Or miss work to take the time off to go down there. We are barely hanging on as it is. Will they make a decision whether we are there or not? How does this work? Do I need to go to my county in Missouri for assistance with this matter? And also have we had a big enough chang in income to have it modified? Any help is appreciated. Thank you. I dont know if that matters but thought I would add in that detail. @ George: He didnt voluntarily take a pay reduction, he was laid off from his job a few days ago, and he was able to get a lower paying job. Unless you are talking about when we moved t MO. then yes he took a pay reduction but that no longer matters I wouldnt think since he was laid off from that job now??
Is my ex-wife entilted to back child support if she closed the child support case and re-opened it again? My ex-wife recently re-opened an old child support case that she has opened and closed over the last 7 years. When she re-opened the case back in October of 2010, she requested back child support from August 2003 and never requested back child support when she re-opened the case in the past. Because she never had the county leger canceled, the state of Florida is stating that I owe her over $44000 since August of 2003. Is she entitled to this money even thou she has closed this case twice in the past. Also apart of our divorce agreement, we have shared custody which means no child support was needed or agreed upon.
Is it legal in Florida to move to another county without any notice with joint custody? My boyfriend ends up finding out his ex moved to another county from his daughter that lives 50/50 time with both parents. She is now in a home with 4 adults and 3 other children. So 8 people in a 3 bedroom house! His daughter is sharing a room with her soon to be step sibling, while her mother, her mothers boyfriend, their daughter together and his son with his ex sleep in another room. Now, from what his daughter says BM says "she cant afford the rent" so they have to move to her boyfriends parents house. Child support information.? I pay childsupport on a son me and the mother didnt know we had until she had to have a emergency c section. Divorce Options, can't afford a lawyer, imputed income,? I need random advice so here is the situation. (Just a disclaimer: I had my own money that I supported my wife with while she was building her career, two days after she got to where she wanted to be and my money was gone she wanted a divorce.) But here it is My wife and I had a kid, I had just started a new job and made 40k a year. I left my job for a few reason but mostly cause I knew my wife couldn't handle the mother thing. I got a job offer and we both agreed that I would stay home with our child till it came through. A year pasted the offer was recinded. She wanted a divorce, I caught her cheating, so I file for it with what little money I had. I had to move to another county in Florida with our child. At mediation, they argued for my income to be imputed at 40k, which I argued against while my lawyer sat there. They ended up imputing at minimum wage. A year has pasted since mediation and we still cannot come to a finalized agreement concerning child support. Since, she has given me sole custody and only wants to see our son 1.5 days a month with 9 days over the holiday season and no other holidays. I have been looking for work for the past year, even in jobs that do pay close to minimum wage but in my field of study, taking care of my son full-time during the day and working on a masters degree at night. While living at my fathers house and I really have no child care help from family members. So I started my son in a part-time daycare, after a year of being home with me he needed it of socialization skills and learning experiences. In the mean time she has received a 16k a year raise, her lawyer let her calculate her new child support payments which came out to like $36 dollars extra a month. I received an email from my lawyer stating that they have filed a counter petition for divorce, are trying to impute income, and probably going to take me through the mediation process again in a county my son nor I live in. My question is, will the court impute income on the basis on what i made for 8 mths 3 yrs ago and because of my education by saying I'm underemployed or willfully unemployed? -Considering the state of the economy there are no jobs in my area I qualify for, companies are requiring years of experience I don't have then even with all the years of experience they are paying close to minimum wage. What happens if I can no longer afford my lawer do I just get screwed over? I can't find out for sure if that is the charge that they are holding him for. He also has a felony charge in another county for embezzelment. He was arrested in Florida on April 7 and has been there for 2 weeks now. I just want to know if he will be extradited and when. Even if the charge is not for the child-support I may be able to at least see him in court if he is brought back to Virginia.

My question is about Fathers rights in Florida and how to implement visitations when the father is paying.? The father is paying child support and can only see the child when convenient for the mother. She ignores phone calls and refuses to allow him to see the child when she feels it is inconveint for her. She agrees to certain dates and then retracts her statements. He has been paying child support and has attempted to set dates when he can see the child which sometime works and other times it does not. All parties live in florida with about a 4 hour drive time between the primary and secondary parents. How does the father go about getting court ordered visitations without a lawyer in osceola county? I have seen alot of information on the web about beginning with a letter of intent to exercise visitations and a letter of intent to exercise parental rights. Other information on myflorida.com has suggested writing up a parenting plan that lays out how he desires to set up visitations but I wish someone would simply give a step by step process on what to do? It seems like there is no information out there about this and the situation is getting worse. It needs to be solved ASAP and I really need help.....Any suggestions??? Please help!
If a father doesn't sign the birth certificate, is the mother allowed to move to a new county? Ok, here is my problem. I have a 3 year old daughter. Back in 2008 hurricane fay hit Florida and my area which was near Tallahassee was under a warning. I went into labor at 8 1/2 months with her. My 4 yr old daughter at the time, ex boyfriend or my unborn daughter's father and myself was told to head to the hostipal. I was admitted but due to the storm coming in they were worried I wouldn't make it back in, if my waters broke or contractions got stronger and closer together. So after I had my daughter the next day, my now ex went to check on my daughter who had spent the nite at his mothers house since the hostipal told us that she couldn't stay there with us. A nurse came in to get infomation for the birth certificate. I informed her the father was checking on my other daughter and she then in turn told me that I must get the information done that day or it would be a week before I could get it in again. And she told me I must have the information in according to state law or I couldn't take my daughter home. I called my now ex and informed him of this and he said go ahead and do it. He will worry about it later. Well I signed it and she is listed as having no father. Well after talking to child support and other people including a lawyer, we were informed it would cost us an arm and a leg to get his name on the record. Now the problem is, since i filed for welfare due to a disability, they wanted a father for my youngest. At the time we stated who is was but then Child Support got invovled and demanded that I file for support on my now ex because he was "Being an unfit father and a dead beat" and I later told them he was helping care for her. I was living with and still am. Now 3 yrs later we aren't together and I am planning to move. I'm moving 5 1/2 hours away to another county and I want to know since he's not on her record, can I legally take her? The problem is the home is unsafe,and im getting some many stories I don't know which to believe. Some say yes I can since she has no legal father and he has no rights since he didn't sign and although he say he's the dad he doesn't have DNA proof. And others are saying i must get written consent and that he has rights even though not on paper. And lastly my friend who works for a sheriffs department says that by law I can take her with me, since I am not court ordered to pay child support, nor is my now ex, since it is not court ordered for him to be on the record and since he is legally not bound to her i can. He would have to go to court file for a DNA test, wait on results and the go from there. She also said that since i had custody, full custody of my daughter that my now ex would have to pay back 3 yrs child support and keep paying till he gets temp custody. He has already told me he doesn't want to do child support and would rather just do visitation on weekends and his days off. So anyone minding helping me out? I live in Florida if that helps. And so sorry this is long but wanted to give details on this! Ok, I don't know our laws here but I do know he can't afford to do court, which is why he just wants visitation. I am just curious because our home is unsafe. Would it cost anything to file for custody? I know i have full custody now of them both according to what the child support office said. Non custodial Parent Rights? I need help… My husband has three children from a previous marriage. They are 17, 11, and 4 years of age. He is and has always been a very big part of their lives. She has custody of them – not sure if it is sole or joint – he is very unclear of this. We all live in the same county of Hernando here in Florida. She is now looking to move to Palm Beach with her boyfriend (who she does not live with currently) which will be 4 hours away. He normally sees his children twice during the week and has them every other weekend. He has also been taking them every other holiday and keeping them an extra day or two when she visits her boyfriend in Palm Beach. He also pays child support through Florida Court. He would need to drive four hours to go get them and then four hours to bring them back to our home and of course the same thing going back. Even if she agreed to do half the trip – he feels later at some point she will stop because of how financially it will take a toll on her. Her moving all the way to Palm Beach would be a hardship for him and it will also not allow him to see his children as much as he sees them now. Can he stop her from moving all the way out there? This situation is really hurting him badly because his children are his world and the thought of losing them somewhat kills him. What can he do on his part or what can be done? What are his rights? Help finding a job as an ex - felon? My dad has been to jail about three times and he needs help finding a job . He didn't go for anything serious just not paying for child support. How do I drop charges in Broward County? I seprated with my sons father and he was never abusive or anything like that but he failed to provide for his child and doesnt assist me with any financial obligations for the child. I recently began the child support paper work and made plans do move to georgia for financial stability as south florida is too expensive for me to live and support my child. I made my sons father aware of my decisions and from that point on it was constant arguements. I feared he would take the child and try preventing me from leaving to Georgia, so I was very careful of visitation and limited visitations to no overnights when he stated he would take the child and then take me to court. I didnt want to prevent him from seeing the child but limit it and monitor it and stick to a schedule. Well we had made plans for him to pick up the child on a sunday and he came to my apt on the wrong sunday. Too make a long story short ... he came over and at that time i had stepped out of the house to run errands and left my child with my sister & brother in my apt....he arrived and started knocking on the door but my siblings were aware of the situation and did not open the door. My sons father proceeded by breaking into the apartment through the window, where my brother tried forcing him out but my sons father struck my brother to enter and after shouting & quickly going through my belongings he attempted to leave with personal info i had on my desk ( copies of me and my sons ss cards & my florida id). He then opened the boxes i had packed..also 3 trash bags filled with dvds along with my son from, the apt...I arrived just as he was leaving and it lead to a messy altercation outside as he attempted to drive off...I positioned my self along the drivers side door and refused to let him leave with my son in the vehicle..he reversed the vehicle injuring my leg and nearly hitting my brother who was attempting to get his tag number for authorities. in the end police arretsed him and charged him with 5 charges. And they are very serious charges from what Ive heard. Charge # 1: BURGLARY/WITH ASSAULT OR BATTERY Charge #2:AGG BATTERY W/DEADLY WEAP DOMESTIC VIOL Charge # 3: TOUCH OR STRIKE/BATTERY Charge # 4: GRAND THEFT>$300<$5000 Charge # 5 : INTERFERE WITH CUSTODY He can not bond out because charge #1 has No Bond. Now his family members continue calling me crying and begging for me to drop the charges. They state that these are serious charges that can result in him doing 5-10 years in jail, but if i can fdrop the charges he will do atleast 1 yr -3 yrs. They say (his family) that he does deserve something for his actions but 5 yrs or more is simply too much and not fair. I do believe he needs to be accountable for his actions, but Im just so confused right now and wooried. I dont know how to go about dropping charges in the event I did would this affect me in any way?? I truely dont know what to think and i know we do stupid things at times but Im truely lost in thoughts right now.. Does he have parental rights? We live in Hernando County Florida. My friend had a baby with his girlfriend.They were not married, but he is on the birth certificate. They've split up, and as far as I know, she hasn't filed for child support, and I know he hasn't filed for custody. Will they do a paternity test when he files? His ex doesn't let him see the baby unless it's conveinant to her, and she holds the baby over his head. Does he have any rights? I read somewhere that he doesn't, because they weren't married, even though he is on the birth certificate. I know you can't kid nap your own child in the state of Florida, so could she up and move, like just leave, with the baby, and he not be able to do anything because he hasn't filed for visitation or anything?
Florida judge will not let me bring my son to MS to visit. Can I sue for alienation of affection? My son told me he was molested by his father when he was 4. My ex took one lie detector test and passed, and the judge gave an order to return him to his father and that I was no longer allowed to remove him from their county. I live 11 hours away. Fathers Visitation rights in Florida? My fiance has a 7 year old daughter with a woman he was never married to - in fact, their child was the result of a very brief relationship. He never wanted to be with the mother, but did want the child, so he initiated the paternity process before his daughter was born, and has paid child support since day 1 of her life (Incidentally, he pays almost as much support for his 1 child as I receive for my 3). The mother married another man shortly after the baby was born, and has since had two other children with him. My fiance's daughter calls the other man "Daddy" as well, and has expressed confusion lately about how, exactly, she has two daddies, even calling my fiance her "step-dad" and saying the other man is her "real dad." We believe she has not been told the truth by her mother, and is truly confused, so we try not to make an issue of it. I know how much it hurts my fiance's feelings, but he truly puts his own hurt aside to simply not rock the boat. My fiance never established any visitation agreement, as he was working out of the state, and at the time, the mother was pretty good about allowing him to see his daughter when he was in town. However, he is only "allowed" to see her on Sundays, he provides all transportation, and sometimes the mother changes her mind as he is on his way to pick her up, citing reasons like play dates, birthday parties, and plans with family as reasons why he can't see her. The daughter has never, in 7 years, spent the night with my fiance because in her words "mommy says I'm not ready." This man is a responsible person, a wonderful step-parent to my three children, and truly one of the best, kindest hearted people I have ever met. Not only is he losing out on valuable years with his daughter, but she is not being allowed the benefit of developing a true relationship with him (or with our family, as her step-family). If anyone could provide insight to the following questions, I would be grateful: 1) we reside in a different county than his daughter (same state). does he have to retain a lawyer in the county where she lives, or can it be where we live? 2) he travels weekly, all over the country, for work, and is frequently gone on the weekends. is this going to affect his visitation, or could I or his parents continue with the visitation schedule that is decided on? 3) would it be better for him, in the long run, to hire an attorney and go after a fair time-sharing schedule, or to propose one to the mother, first, as a plan to see if she will agree to it. then if she doesn't agree...hire an attorney? 4) forgot to mention - the mother gave the child her legal last name, which her new husband switched to, and the new siblings also have (perpetuating the confusion of how her "real" daddy fits in to her life!). how likely would it be for a court to grant a petition to change his daughter's last name to his, or to hyphenate it...adding his last name to the end of hers? So, I have read over and over again that if you can prove that you have a child with the man your wanting to marry that you can obtain a marriage licance without parents permission. My son is going through a messy divorce and cutody battle and needs legal help? He has already paid 20K in attorney fees and 1400.00 per month child support which is half his net pay. He was forced to let go of the attorney he cant afford it any more. It took him a year to see his three small children and now she is blocking him by filing a false DCF report alledging he flashed the kids while he had them in is custody. My brother lives in Palm Beach County, Florida and his ex-wife recenlty remarried and has petitioned the court to let her move their 2 kids to Virginia to be with her new hubby. She is also petitioning that everytime my brother flies the kids to Florida to see him (which I'm not sure why it is all financially his responsibility) he must also buy her a ticket to come to. (Her whole family lives in Florida, so it would basically be him paying for a mini-vacation for her.) Suppose I punch out my soon to be ex-boss.? Here's my story, sorry if it's a bit lengthy. At the tragic expense of my grandfather's sudden and early death, I've recived my multi-million dollar inheritence earlier than anticipated. He was an executive for Warren Buffets Berkshire Hathaway and bought up several hundred shares of stock while they were dirt cheap. My current financial situation is this: A 41 year annuity of $207'000.00 a year (Actually direct deposits monthly.) Also a secluded cabin in the Hawaiian islands as my permanent residence, and 1.5 Million remaining in uncommited dollars spread out in three bank accounts, that will be my retirement when my annuity runs out at the age of 61. As you can see, I'm a 20 years man and set for life. Further more, and you can correct me if I'm wrong about this, that's why I'm here asking, but it would seem that I have nothing to lose when I go in for my final check. You see, a week from this friday, I go in for my final check. I am assistant manager at a golf course and absolutly despise the boss. She has made the last year of my life miserable, and instead of going out with a handshake, I'm thinking of going out with a literal bang. Because, I live in Pensacola county Florida, and my flight to my new life in Hawaii is 11am a week from friday in Tampa. This is my opinion: Even though Tampa, the location of an airport is a neighboring county, the process of extradition remains nonetheless. So, even if she can tell the police I'm there (Which I do not believe she would know), there would be way too much legistical stuff to be able to get me before the flight takes off. (Even if they did, i could pay my bail, then leave, and consider it worth it.) As single mom collecting child support, we can rule out her suing. She would not only have travel expense that she likely cannot afford, but there's absolutly no way on earth she can afford an attorney who can take on the one I hire. Not to sound like I'm gloating, but I can afford any attorney on earth, she cannot. Expect her to not even consider civil action. I don't like her attitude, but she's not downright stupid. Last but not least, this IS a repost. I'm asking again because last time everyone was talking about extradition. Consider it this way: The DA is going to pay out of his budget, provided by taxpayers, to have me extradited all the way back from Hawaii over a simple assualt charge. He's gonna cover the expense of my arrest in Hawaii, and pay to put me on a plane, and fly me halfway across the pacific just to get to the west coast, than transfer planes on or two times back to tampa? Simple assault charge? I think we can rule out extradition of that distance for 90 % of all crimes. So, am I foolproof.
How can I get a lawyer? Hi, I have someone that will pay for me to get a lawyer, but I myself cannot afford a lawyer. Its for CHILD SUPPORT. Not to mention, the times he does talk to my son ends up in a nightmare - two nights ago he accused my 13 year old son of doing something he didn't do (which was make his girlfriend cry; even his girlfriend says it didn't happen!). That was the final straw for my son, he told my ex to get out of his life, called him a horrible father, and that he never wanted to talk to him again. Child support is NO help, I'm thinking of calling news stations and a congressperson or senator in Florida (Duval County). Since I know nothing about politics, who should I contact - a congressperson or senator? And who would it be in Duval County, FL. I have heard that Salvation Army or Red Cross may help with utilities while one is not able to work, but not sure about mortgage payments? I was diagnosed with a brain tumor (non-cancerous) 4 years ago, and doc told me yesterday that it is time to remove the tumor as it keeps getting bigger and causing my brain to swell, and told me that he has my surgery scheduled for 2/24/10....that is coming up quick! I have health insurance and short term disability with my job, however at my job when out on short term disability you only get paid 60% of your regular salary, I know because I was out 2 weeks in August for female surgery. The problem is, I am on the cusp of bankruptcy, I owe another $140 to my attorney and then he will file my case.....I have been chipping away at this $1875 since this past summer. I drive an 11 year old car and I live in a mobile home, so there definately no extravgances here. I am paying my mortgage about 30 days behind and at one point at the end of the year got I 2 months behind and had to come up with $2300 in 1 month time to cure the default. Needless to say, there was no Christmas, but there also was not much left even for food.....I was able to get a food handout from a local church but it wasn't much. My thinking is that if I am already struggling while working full time, how will I ever be able to make it when I am off work for 1 whole month at only 60% of my wages? I hate being in this position, but medical bills and being left by my fiancee early last year, put me in a financial downward spiral.....I have had to pay everything on my own and I would venture to say I probably have a credit score of -100. I have even started renting out rooms in my house, yet it still isn't enough. Is there ANYWHRE, where I could get help with my mortgage, electric and maybe some food? I do have bank statements/paystubs and etc to backup my case, but where would I go to get help without having to go through a lot of red tape, as I don't have a lot of time? I am not on any public assistance programs and never have been as I have always made too much $, so I really do not know where to even begin? If anyone out here has been through a sugery/illness for an extended period of time or if you know someone who has and they were able to get some kind of help, so they didn't end up without electricity, hungry or homeless, I would be very interested in hearing about your experience and how you were able to get help. Mother is Moving to another state.....again!? My ex-wife, since the divorce, has a sporadic moving lifestyle due to financial reasons and basically to avoid child support. She moved around TN for a while and then moved to FL for about 8 months before she moved to Ohio where I live. She even moved within Florida before she moved to Ohio and never told me about it. She came here for about 4 months and she is now moving to NC. Of course it seems that she always moves just as the heat comes on her about child support and the county begins to take action against her. She did give me a 60 day notice this time that she plans on moving but all indications tell me that she is going to move this weekend. That makes the notice only a 14 day notice. And I also see the reasons as being pretty bogus too as they contradict the reasons as to why she moved here. I guess I am just looking for some outside opinions on this situation because I would love to be as hard on her as I can be but the girls still love her of course but don't understand what I see. I think it is very unfair for one parent to take the responsibility to raise the children while the other plays the avoidance game but gets to be the fun parent when they see the kids.

Terminating parental rights? Hello. I am a mother of three. My youngest daughters were conceived with my husband. My oldest daughter was not. My husband has helped me take care of my oldest daughter for the past five years since she was 15 months old. She calls him Daddy and he refers to her as his little girl. It's no surprise that he wants to adopt her. That's the daisies and sunshine part of this question. My daughter's biological father has had no part of her life since she was 12 1/2 months old. I broke off our almost three year relationship because I realized that no matter what, he would never stop being an alcoholic or mentally abusive to me. I also saw that he was becoming more mentally abusive to our daughter. I talked to him several times over the next few weeks in hopes that he and I could figure out some sort of visitation on our own. We agreed that I would always be present and we would be in public. However, he always put it off, saying that he was busy working. Three weeks after I left him, he called to inform me that he was moving to Florida. He didn't ask to see our daughter and it broke my heart that he could turn on her so efficiently. At that point, I contacted the local DHS to receive child support payments. They couldn't find him for over a year. When they did, he had a job and they started taking child support from him. Four months after that, the payments stopped and he was 'lost' again. Another year and 1/2 later, they found him and brought him back to WI for failure to pay child support (3 counts). Apparently, he had three children in Grant County alone. He has been paying child support for nearly a year now, but the payments per month deviate significantly from the original court-ordered amount of $204/month. Now, after the very long-winded explanation, here is my question: What are my husband's and my chances of terminating the biological father's rights so that my husband can officially adopt my child? Are there any specific laws that will help our case? Do you have any websites to help us out? Thank you.
WHat are my options or legal rights to my deceased fathers remains and information regarding him? I posted a question months ago and this is a follow up question. In short- my father died september of 2009- I was not notified of his death till november 26, 2010 and that was only by a letter from the attorney general of Texas in regards to the other parent involved in my mothers child support case had deceased and the case was closed. After endless searching and finally tracking down his "x-girlfriend" and contacting the funeral home (Dobies Funeral Home) I was able to gather this very minimal information. Lewis william wood DOB- February 1958 DOD -september 24,2008 in New Port Richey, Florida in Pasco County FL. His obituary-WOOD, Lewis W., 50, of New Port Richey, Fl., died September 24, 2008. He is survived by his fiancee, Ingrid ******; son, *******; mother, *********; and best friend, *********. Dobies Funeral Home. I contacted the county he resided in and there is no estate or probate for him. Only thru the kind soul owner of the funeral home I was able to find out- He was declared indigent and his body was cremated and his remains were released to his "girlfriend" they did have a small child together but did not live together or were married. So that's I got. My parents divorced in 1995- and since then my mother has blocked any communication he ever attempted and I was unaware till not- so asking her or my family for any information or help is not an option. So finally questions are What are my legal rights as his descended his remains? Any possession's I am not out for money or property as he was indigent- but more personal effects- information? Also is there any legal action that I can take in regards to not being informed in a timely manner of his death and legal action against the county- state- whomever is in charge of notifying family members - because had I been notified I would of never let him be cremated and first and foremost his remains would be properly released to his 2 surviving children my brother and I. Im so lost and feel completely helpless as to what I can do and how I can go forward with getting info and why this slip thru the cracks and took 2 years for a letter to be sent out. Also the "girlfriend" has not been any help and only wrote me twice with the simple statement " Im sorry for your loss". Donna- No she was given the information that he was previously married and she was fully aware that he had 2 children living in the state of texas- proof was when I wrote with her she confirmed it - but she did not tell that information to the funeral home- and you said how would Florida know he had children- as I stated in question there was an open ongoing child support case between him and my mother and he was automatically drafted from his check the payments. So I don't see how it would be so hard to verify he had living descendants. Also Florida's attorney general was the one that informed Texas;s attorney general of his death (2 years later) and that is how I found out thru a letter from the texas attorney general child support office. and to the others- I have no problems with the other baby mama- and I have written with her several times and have given her all my info to contact me and to pass on to by half brother if ever she chooses to. I think you all are missing the point- im not asking to bring some sort of retribution upon the x- I know its not her fault. But he was declared indigent and with that you would have to have documentation of his finances and if they looked at his job and check stubs it would show the child support payments and also court records of the open case. And although they divorced when i was 10 I did receive a few letters and 1 phone call while my mother was not home so I know he knew that I DID want any and all contact with him- my mother handled the rest. And his remains are still very much in tacked sitting on the x's dresser. And I would make a scrap book of all this pictures if I HAD ANY. Does the death of one Ex Make the Divorce Decree null? and void where it concerns the education of the child ? Unfortunately, the child of this marriage is 19 and although not emancipated, still needs to be supported. She's decided to move to FL to be with her deadbeat dad believing that one parent is better than none. He was legally bound to pay $119 per week for her support and 1/2 of medical ( he never helped her with medical bills) and college bills. He did pay half of the first year's tuition until my daughter was hospitalized with stage 4 cancer & died within 13 weeks. He tried to stop the money being taken out of his pay; but NJ has the strictest Child Support laws in the US so they kept taking it out of his pay but they still have the money (over 6 months). My granddaughter never got a penny yet & if she gets it, living with him, he will take it. We had to support her until she moved to Florida. I just paid her full college tuition for the Fall because it had to be paid by 6 pm the day I called. She was in the financial aid office ( I guess for his $ ?) but she didn't even tell us when it was due. I charged the tuition and since I paid for all the this semester, we expect him to pay for the Spring semester. We told her to tell him that & she thought it was a good idea & it gives him 4 months to save --but she let it go until the end because her mother always bailed him out (even out of jail once)! My question is if one party dies, does that make the divorce agreement Null and Void? Or does a court order have to be made to continue the agreement? Or what? We went to 2 different county Courts but they really didn't help us except to say either she or he needs a new court order to change the payee from my daughter's name to her daughter's name. I just wish the money would go into her educational Trust Fund instead of to him. Creator 7, you need to read questions more carefully. Need some advice for family law issue!!? My boyfriend lives in florida, his daughter (6 yrs) lives in California. The daughter lives with the grandmother (75 yrs) full-time because the mother lives in a sober living community (rehab). He can only see her if he travels and stays in California. The mother wont let her come visit in Florida at all. All of the child support, $761, goes to the mother who is in a completely different county than the daughter. He went to California in the beggining of Sept. to visit and filed paper work for joint custody, visitation and a modification of support. They gave him a court date for 1/11/10. We were upset to wait five months but have been looking forward to it. So yesterday was the court date and he was instructed to call in for the telephonic hearing at 6 pm our time, 3 pm their time. All of the phones were busy every time he called. Finally he called the court house and the lady told him that the phone lines were down and they would issue him another date, which would be may 6, 2010. He was devastated! What should he do? Is there any form to file for a quicker date? Will a lawyer help speed it up or can he do something on his own?
Bankruptcy questions for florida residents...? I live in Hillsborough County, FL I have 27 years left on a 30 year mortgage, I am a single parent, Head of Household, I do get $494.50 a month for child support. I have 2 rooms that I rent out for $790 a month and I bring home from my job between $1600-$1800 net. I have a 401K with my job, with about $2K it it and a $750 loan I am paying back into it. I also drive a 10 year old car w/122K miles that is paid for. I live in a mobile home on 1/2 acre with a monthly mortgage of $1165 a month, groceries $400 a month, gas $70 a month, electric $180 a month, homeowners dues of $20.00 a month and I could go on and on....In short my total expenses are $2691 and my income $3085 leaving me with disposable income of $394 which usually goes for school stuff for my kid, haircuts, clothes for us and etc. My debts altoghter secured & unsecured are about $22K, and I will have to pay on my student loans $75.00 a month starting in September. I really own nothing very valuable. I'd like to point out that a few of these debts are medical as I have had some ongoing health problems and some are just life. Everything was fine until last year. My fiancee got fired from his job, had a drinking problem, cashed out his 401K and that was how he paid his half of the bills. He never got another job as he got so consumed in his alcohol problem, his money ran out and I became so fed up at his lack of concern for our problem that I threw him out in March 2009. I don't need to be judged or snickered at, I know it all looks bad, my first question is, will I be allowed to file Chapter 7? Will they try to take my house & car? Also, as corny as it sounds I work in the insurance field and if I file bankruptcy and they find out about it, will that cause me to lose my job? I know they won't initially hire you in those type of positions if you have a bankruptcy. I am so scared and afraid, I just don't know what to do. I was going thru a debt settlement firm, but I didn't have enough $$ built up with them for them to settle my debts and I am getting letters/certified letters that if I don't pay the full balance I owe by next Friday, (and for some creditors that is about as much as $5000) they will begin the lawsuit process on me, so I think this is the only option I have and I do not see my financial condition improving, so I know I must file. I just want to know what to expect for FL. Please know that I don't mess around with my mortgage or any secured debt, I always pay things that I know can be taken away/repossessed. It's just that I have so much expense and so much unsecured credit debt that I am literally drowning in it. Please help me!
Are there services assistance for dads in getting custody of there child/children? My son and my grand child have been abused by the mother of his son to the point of where my son has had to move out of their living situation. My son would never think of taking his son away from his mother. well, over a period of 3 years sense the birth of my grandson and my son moving out. my son and i have to put up with the mother cussing and screaming in front of our house with all of our neighbors listening and worst yet with my grandson listening. we have done every thing we can to appease her but to know avail. our neighbors have complained and I have had it. I have taken out a restraining order which she has violated several times. when my son has tired to talk to her about her behavior his ex gets even louder and even have taken to hitting my son especially in the face and my son will not do anything to her because she is his sons mothers and my son has never hit a woman in his life and would not know even how to go about raising his hand to do such a thing. well arrangements were made to have my son pick up his son at the Broward County Sheriffs office because of the restraining order. and so that left her with only the phone to cuss me and my son and ended her nail marks to his face. when arrangements were being made to pick my grand son up. This made it some what easier for me and my son, especially for the neighbors to no longer have to hear the cussing and witness the beat down of my son in front of her son. While picking up my grandson at the Broward sheriff department my grandsons mother got out of her car and came over and started screaming at us in front of the police and her son once again. thank goodness the law officer was there. this was in direct violation of her restraining order. she has broken her restraining order at least 3 times. and this time the judge called her in on it and she has been arrested w/o bail and is awaiting trial. this is her third arrest for violation but this time it is without bail. by son is having a hard time getting custody proceeding started to obtain temporary custody of his son. is there any help for dads that are good dads and seeking help to gain custody of there child/children. advice would be helpful money is funny right now in these economic time for a lawyer. are there any support agencies in the state of florida for dads or the country where my son can get some assistant with legal advice? I never heard of a woman abusing a man before. I have read up on this to educate myself and I was shocked to find that my son is one of many men that are abused by females. and this this type of abuse is less reported because there isn't much help for the man. I read that there are cases where shelters are now by law allowing men to enter battered shelter. I believe that this is progressive for many great dads like my son

Very Serious Question? I have a friend who is divorced and shares custody of his kids with his ex wife the kids reside with the mother though. The mother is wanting to up and leave with her fiance and the kids to move to Hawaii they and the father live in florida. The divorce papers state she can only move to counties bordering brevard county where we all live.She is taking my friend to court to have it motified and my friend dont want the kids going to Hawaii which is understandable because she has nothing out there no family no work, nothing its an irrational decision she is making. I want to leave my house.? I am 15, a freshman in high school and I'm in the IB program (an intellectually challenging and rigorous high school program) making good grades. I have never in my life done anything to get in trouble. I have not smoked a cigarette, drank alcohol, had sex, or done any drugs. I've never gone behind my mother's back or my step dad's. Me and my mom have never had any problems but recently she has been smothering me and my older sister, who is 16. Things started getting worse after my sister began dating a 20-year-old. Which, to me, is really not a bad thing. Four years is nothing compared to relationships they find completely acceptable, like a friend of her's who is 48 and dating a 33-year-old. And in the state of Florida the age of consent law state that this is not unlawful, so nothing illegal is happening. At first she was simply paranoid and continuously asked me questions about their relationship and made me go everywhere with them as a chaperon. But a few nights ago I asked to go with my friends- and one of the friend's mother- to a show at a local venue and she denied me. She has never done this before and it really hurt my feelings because not only are her actions questioning my ability to make good decisions but my friend's as well. And in doing so she is questioning the parenting they've received. When I do leave the house I have to keep in constant contact with her or she immediately calls for me to come home. When I'm home, things are cold and if she's not talking to me, she's complaining or saying negative things about people I care about. And lately, my home troubles have been affecting my grades because she's not allotting me enough time to do all my work or I'm too upset to do work properly. Living with my father is not an option. He lives too far away and I'm not willing to move out of my school district/county because that would call for me to leave the IB program. Plus, I doubt that he would even want to give it a shot, it's just not something I see in his character. However, I feel with some convince I could get him to pay his child support. Last night a close friend of mine said that I could live with her and another friend has offered the same thing, but neither of them could be long term so I'd have to hop between the two. Also, I'd have to get a job so that I'd have some money to support myself in this. I already know of a few places that are hiring. I can't reason with my mom about anything anymore and things keep getting worse. I don't have the willpower to live like this for another three years. A judge granted shared custody but my ex has nothing to do with our son? Can I GET "full custody? I live in Florida. Three years ago a judge granted shared custody of our son to my ex husband and I. He moved away over a year ago, hasn't called since Aug of 2010, and hasn't seen our son in a year. The judge granted no child support, and us to share taxes on our son (each of us get to claim him every other year). Dec 2009, my ex picked up my son from school (after not hearing from him for months) and did not tell me. I found out by my babysitter calling me and saying my son didn't get off the bus. I called the school, they told me his dad picked him up. This is when I found out that he moved out of town. I have no clue where he lives now, and all his phone numbers are disconnected. I don't want him to pick him up, not tell me and I have no information on him. The judge is not very nice, right after the divorce I took my ex back to court for contempt twice. The judge basically did nothing. I am afraid that if I spend the money to go back to court for full custody the judge is going to not agree to give me full custody. He is the only judge for family matters in this county. If he does not agree, can I go around him or an appeals office? Help!
Chances at UF or other colleges? Hello everyone! I am a junior in a good Florida public school, the best in the community. As a senior year approaches, I am really freaking out about grades and getting into college.. and mostly how I am going to pay for it. I want to either do something in the medical/dental field or possibly in Business. I will be shadowing hopefully someone of both jobs in the summer to get an idea of what I really would like to do. Here is how I stand right now. - White Female - right now uw 3.65/ w 4.0 hopefully by end of the year with a point or two higher in both gpas - 3 AP classes (Bio, US, Lang) self study AP environmental - one dual enrollment (college algebra) - all honors courses this year other than adv agriscience for my club - FLVS Algebra 2 honors - Honors classes (this year/last year) : Statistics, World His, Eng, Geometry, Chem, Spanish 3 - I got a 4.5 w gpa for my third quarter junior year (2 Bs in honor classes, all rest As) - SAT scores were not too good, first time a 580 M, 470 CR 550 W , I know I can significantly pull those up with practice and studying - 200 hours community service at a science museum/camp counselor - Did a program for over 60 hours, so now I will sit on a board with a number of adults and myself in my county - Secretary of Biology Club - Reporter of the FFA (hopefully move up in positions next year) - Instead of going to my high school for senior year, I am going to the local state college and taking four classes a semester, and maybe AP stat online classes I want are english, spanish, maybe general chemistry, macro/government, calculus, not sure what else! So I am obviously looking into UF, because I can use bright futures and hopefully have most of my expenses paid. But I really wanted to go out of state, up to maybe New York City or anywhere in the north if there was anyway I could get most, if not all paid for. My parents (mom and step dad) make over 120k and even though my dad pays no child support, I do not think I can receive financial aid or it will be hard to. I am bringing a new and better project this summer to state convention so I can hopefully take first and go to nationals. I also got first place at our county envirothon. Other competetions I have been in include: Enviromental Science State (9th team)(26th individual), Horse and Livestock Judging (150ish place alone out of like 300 something, not too good). Thanks!
Child Custody Case, Need Advice ? I attended court today and the judge ordered both parties to have investigations involved, being we both have made claims about each other. All I was requesting was joint physical and legal custody, but, the Respondent is seeking full physical and legal custody. However, after further reviewing my case and all pertinent information in regards to this matter, I feel that it would be in the best interest of my son to be with me, his father. For many reasons that I would like to further discuss, that even the investigator him self was shell shocked to hear. The Respondent is completely violent and an angry person. A.She has a past history of using marijuana, speed, and other control substances B.Has Been Domestically Violent towards me (I have police reports and pics of me scratched up) C.Respondent is incapable of working and has not worked for 4 years D.Respondent is unfit to take care herself, that is why she works as a prostitute And I have several emails of her soliciting for money. Saying she charges traveling and overnight charge E.On several occasions Respondent would take her daughter on these trips, to go play hooker and be with guys, Such as Walt Disney World in Florida, and Sea World in San Diego, Ca, (I have emails to support this) F.One incident she left her daughter home alone to go be with another guy, her daughter then left the house looking for her mother, to only be found several blocks away by a couple, cops were called (Police Report) G.Respondent has a past history of violence with her daughters Father. (Police Reports) H.Works as a stripper out of her surrounding cities, in Ca. Nickname Lily but does more "Prostitution" I know where this location is. . I.Respondents daughter does not live with her mother because she is very much traumatized and afraid her mom will dump her off, to go be prostitute for the night, according to her own daughter. J.I have witnessed Respondents interaction with her own daughter, and she yells and can be violent to her own daughter, threatening to spank her if she (daughter) does not listen to mother. She has admitted to me that she smoked weed in her apartment while our son was in the other room, this occurred beginning of August. N. She has not reported her income to the IRS for past three to four years, which says alot. She already has possibly FRAUD and PERJURY, But possibly Now TAX EVASION, . O. She pays an estimated 45k in mortgage and property taxes and has a paid off Jag, but she does not work according to her Docs, Huge RED FLAG. P. Her neighbors apartment has been raided twice for drugs, and yet they still sell drugs. Being I know all of this she feels that she must bash me by making up false accusations about me, However, I am very well prepared and can support every single claim that I noted above. She on the other hand cannot, but merely do her best to make me look bad. My children are going to live temporarily with bio father who they don't know...can a private attorney help? I have am open case with DCF in Florida..i'm working on a case plan but in th meantime, my exhusband , whose name was not on the birth certificate of either child, came forward and paid for a paternity test....he has always known they were his, but has never had anything to do with them since their birth til now. My babies , 3 & 2, have been with my mother the last 4 months til my ex husband decided to get in the middle now that he knew my mother had filed for child support for helping them while they y were with her. Last week, I went to court, and they were "supposed" to be arranging visitation for their father to have visitation at the hearing, but instead the judge decided to give him custody after doing a home inspection if he passes. The guy has NO stability whatsoever. He has lived in 5 differnet counties over the 4 years, works random jobs from driving cabs to pizza delivery...has been in homeless shelters, lived in motels, small camper trailers, and rents month to month wherever he goes....he lives 3 hours away. My kids have only known mine and my mothers home...they dont even know him.....how can they jump past visitation to placing them with him although he has never even been around children and has no knowledge of rearing a child?? A minor who swears that they have a child or are expecting a baby, can apply for a license if the pregnancy has been verfied by a written statement from a licensed physician. A county court judge may at his/her discretion issue or not issue a license for them to marry So if I provide proof that I'm pregnant, can we get married before I turn 18? I am being fined the wrong amount on a seat belt violation. How do i get it fixed? I was on my way to class the other day and was waiting for a red light to change when an officer asked me to pull over when the light changed green; mind you I had been at the red light for at least a minute or two before he hit his siren and tapped on my window. After we pulled into the parking lot of the nearby apartment complex, the officer cited me with a $123.00 seat belt violation, no other violations were mentioned what so ever. I looked it up, and a seat belt violation for a driver in Florida is only supposed to cost $30.00 and they can only get you for the violation if they stop you for a different traffic violation first. What can I do to argue this fine amount, either to get it thrown out entirely or at lest reduced. I don't mind paying $30 but $123 is excessive especially since I am a poor college student. "316.614 Safety Belt Usage (1) This section may be cited as the "Florida Safety Belt Law." A truck having a gross vehicle weight rating of more than 26,000 pounds. 5. A motorcycle, moped, or bicycle. (b) "Safety belt" means a seat belt assembly that meets the requirements established under Federal Motor Vehicle Safety Standard No. 208, 49 C.F.R. s. 571.208. (c) "Restrained by a safety belt" means being restricted by an appropriately adjusted safety belt which is properly fastened at all times when a motor vehicle is in motion. (4) It is unlawful for any person: (a) To operate a motor vehicle in this state unless each passenger and the operator of the vehicle under the age of 18 years is restrained by a safety belt or by a child restraint device pursuant to s. 316.613, if applicable; or (b) To operate a motor vehicle in this state unless the person is restrained by a safety belt. (5) It is unlawful for any person 18 years of age or older to be a passenger in the front seat of a motor vehicle unless such person is restrained by a safety belt when the vehicle is in motion. (6)(a) Neither a person who is certified by a physician as having a medical condition that causes the use of a safety belt to be inappropriate or dangerous nor an employee of a newspaper home delivery service while in the course of his or her employment delivering newspapers on home delivery routes is required to be restrained by a safety belt. (b) The number of front seat passengers of a pickup truck required to wear a safety belt pursuant to this section shall not exceed the number of safety belts which were installed in the front seat of such pickup truck by the manufacturer. (c) An employee of a solid waste or recyclable collection service is not required to be restrained by a safety belt while in the course of employment collecting solid waste or recyclables on designated routes. (d) The requirements of this section shall not apply to the living quarters of a recreational vehicle or a space within a truck body primarily intended for merchandise or property. (7) It is the intent of the Legislature that all state, county, and local law enforcement agencies, safety councils, and public school systems, in recognition of the fatalities and injuries attributed to unrestrained occupancy of motor vehicles, shall conduct a continuing safety and public awareness campaign as to the magnitude of the problem and adopt programs designed to encourage compliance with the safety belt usage requirements of this section. (8) Any person who violates the provisions of this section commits a non moving violation, punishable as provided in chapter 318. How can I handle my grandson's mother? I have been caring for my now 1 year old grandson since he was 1 week old. Dad in federal prison, Mom in county jail waiting for sentencing. She got sentenced today. 6 months with time served. That would have her released by Oct 1..with time served. Drugs were a problem for both of them. Father agrees the best place for the child is with me. Father gave consent for custody. Mom said she would , But changed her mind while in jail..Says the guardienship paper was fine while she was gone and now she wants to come back to my house to live and have her son back. I have supported her when she was in and out of rehab and have always been on good terms.But not so good after a month long drug binge when she ran from a warrant. she did turned herself in on VOP in June, She refused visitation for me and her son. Would not call. Also wanted to know why I needed temporary custody. What were my intentions. I just want what is best for the child. I am not rich but do work.I was advised by an attorney to serve her papers and file for custody before she is released. . Also I filed fwith DCF for assistance for the baby. Does the custodial parent have to pay child support? In Florida (specifically Orange County), if the non-custodial parent only has the child for maybe 4 months out of the year, when the child is visiting the non-custodial parent, does the custodial parent have to pay child support for the month (or however long) the child is visiting? And where can I find this information in writing? It's not for me - my boyfriend has custody of his son, so far his ex has yet to pay child support. But out of the blue she wants copies of the paperwork so she can start paying. He's worried she's going to start paying because in November she wants him for like three weeks (he's in year rounds school) and my boyfriend thinks during that time, he's going to have to pay her. how to get change of venue granted? Both former husband (FH)wife(FW) divorced in Broward County, Florida. FH gave FW permission to move to Clay County Florida in 2005. FH no longer resides in Broward County as of July, 2007. FH has so far been found in 5 contempts of the marital settlement agreement. FW is on permanent disabilty and FH does not pay child support and alimony as he should (a sixth motion for child support enforcement is filed in court). FW filed motion to have the venue change from Broward to Clay County florida where her and minor child reside. FW was denied by the court (child modification and sixth motion for contempt is filed and FW told court she is willing to strike the motions if she can get the venue change and then will refile at a later date) the venue change. FLGovernor Bush sent a friend I form letter saying he cannot help him in legal matters so why is making laws? The man I know has a daughter he lost in a custody battle to an exwife who has been in and out of jail for felony drug arrests. The local judge in Okaloosa County does not like him so he keeps making him pay more child support every time he takes her back to court for custody battle because of her continued illegal drug abuse. So he wrote Governor Bush asking for help in the matter and he sent back a letter stating he could not help in legal matters such that he should go get a lawyer. He had a lawyer he stated that in the letter he wrote. So why is Governor Bush unable to affect the laws in regards to the safety and security of children in regards to a poorly done court case by a judge who will not set aside personal differences to think about the welfare of a child in the dangerous drug environment of her mother but he is capable of enacting, initiating and making laws in Florida? Is this a governor or a politician who should be in office? This is currently the standard form letter being sent out by many politicians in office in Florida I recieved this exact form letter recently when I contacted Senator Martinez in regards to the illegal things immigration is doing for him to say to me he cannot do anything legal get a lawyer. I got an incompletely stamped signature on my letter in red ink so I know for sure he cared enough to read my letter enough to waste four months of my time waiting for a reply after sending in all the required information the other form letters requested.
Why Do Florida Schools Refuse To Get Involved? This would never happen in North Jersey. My step-kids go to school in Florida. My step-son is a high school freshman and my step-daughter in 7th grade. She gave me the log-in information for her school's Edline, so I can see that her grades in this Middle School she is attending in Palm Beach County have been pretty lousy since day one. I can't see my stepson's grades, but he has always been a poor student. He had to go to summer school last summer, so I imagine that nothing has changed with him. What's "pretty lousy"? How about an average in Science at 23. Yes, 23. A really REALLY low F. Her current Language Arts average is a ZERO. I think she is only passing Math and the elective now. All other classes are an F. I have sent e-mails to everyone I could think of. The Superindendent of the Palm Beach County board of Ed, to the Intervention counselor who works with kids who have the potential to drop out, to the Principal of the Middle School. I have asked them how long they allow a child to fail before stepping in. I've advised them that the mother stays down in Ft. Lauderdale all week with the internet boyfriend, so there is no supervision at home each night, and this is why homework is not being done. The number of zeroes my step-daughter has received is mind boggling!! The most important thing I told them was that I did not expect them to answer me personally. I know as a step-Mom that I have no rights. However, when I had these kids with me, I was more of a mother to them in two years than their mother has ever been and will ever be. What kind of a mother doesn't give a rats' tail if her kids fail in school? What kind of a mother doesn't get involved when their kids get ZEROES? I don't know what she has or has not done, but I can say this....the grades are getting WORSE, not better. I just don't understand how a school district can stand by idly and allow this to happen. There has to be some kind of in-school assistance program to help kids whose parents are completely uninvolved. Kids are falling through the cracks and the schools don't seem to want to get involved. Yes, I will state that the mother is what you'd call a "head case". Very prone to histrionics. She claims to be a Science Teacher, but is not listed as an employee of the School District. She did have a teaching job about 5-6 years ago and lasted about 3 weeks before staging a little breakdown in the school. She was looked upon disfavorably after that. However, the mental state of the mother should not prevent a school from helping kids. Their Dad is dead. This is not what he would have wanted for these kids. I love them and want them with me, but the mother wants the Social Security money she gets. It allows her not to have to get a job. I'd let her keep the damn money. I make enough to support these kids along with their baby sister. It breaks my heart every time I sign on and see that my little girl is failing in school. She has A student capabilities. I think she may be crying out for help and told as much to the schools. Nobody is helping. Can someone on the "inside" of the Palm Beach County school district speak to this? Thank you. She has never been involved in their education and doesn't even bother staying home at night. The kids are 12 and 15, and will NOT do their homework unless a parent is there encouraging them. I had to provide tons of positive reinforcement to get them to put effort into their schoolwork. Once they went back to their mother shortly before their Dad died, they regressed big time. florida divorce question? have this friend living in florida, she is a mom, without much money, the husband is bad news. legal aide claims they cannot help her lack of funds. the court in her county advised she seek an attorney but she has no money as the husband pays no support and they can't locate him. she is also going to seek custody of her two children. is there any way she can do this without having to pay an attorney? the paperwork she can get from a paralegal would it cover having children or is she stuck without any hope? she has asked the court to waive the fees, but they say unless the husband can be found they can't help they claim they do not have the paperwork thats needed that only the attorney's have the paperwork. is there any way anyone knows that she can get her divorce other than paying out thousands to an attorney. theres no way she can pay and they won't help her.
Can I get the non custodial parents rights taken away if he has very little or no involvement w/our children? I LIVE IN FLORIDA....He's never been consistently in their life. He owes about $14,000 in child support. Always getting in trouble with the law for something, so therefor he is always on probation and he is about to be done serving 45 days in county jail. We have went several months without any contact, when I say several I mean like 6 mo. without contact. His parents are the same way, they don't keep in contact with me about their grandchildren. He has never really wanted anything to do with them until now. Now he has a girlfriend and is actually calling and fighting me on getting the kids on weekend. He thinks he can just call and disrupt everything that we've had going on for years now. The only time he wants the kids is if he has a gf, so she can take care of them instead of him. Can I get his rights taken away from him. They have a step dad that provides them with all the love and support they need and they don't even ask about him. I don't see how the court would be ok with him not supporting his kids and being in and out of their life..That's not good for them mentally. what are the statute of limitation laws in MI and OH for gross sexual imposition and criminal sexual conduct? A close friend of mine was charged with gross sexual imposition by a minor female from over 10 years ago in the state of MI. Also with criminal sexual conduct from his daughter in the state of OH. I know this man did not do this! His ex-wife is mad because he lost his job and she is no longer getting child support and his two younger kids want to move with him to Florida where he currently resides. The ex also stated she knew of this over a year ago. Broward county sheriffs, where he is in jail, said there should be no case but OH is extraditing him here for trial I assume. Help!! I have 2 questions about family law...can't afford a lawyer? 1....does anyone know what my rights are in the matter of family law and changing a venue?? My ex opened a case 2 counties from me. Since my summons, I addressed the court and told them this was not my county and that I cannot get to this county and the reasons why. I asked for a change in venue with the courts after this (about 3 months) because they kept sending mediation notices and I kept sending notarized and certified letters telling them I wouldn't be there and why.I now have received a letter from the other party ..a motion to strike...(since my motion to change venue and transfer of court files). So, should I have a rebuttal or opposition to this or let the judge decide??? I live in Florida. 2.. my other question was also in this matter and the fact that I cannot get to this county for mediation and the such, are there any rights I might have? I take care of the child without any support from the father and there is an open case with the state for support which is in my county. Is there anything in law stating that I can get the mediation transferred. ( This is why I asked for a change in venue). The minor child and I have never resided anywhere else. The child nor I have never been or lived in that county. Have I already done all I can???

And if another candidate like Mike Huckabee is no longer in the race at the time of the state convention in June, his delegates are free to support whomever they want. Today he's the most notorious man online. The twenty-eight-year-old founder of nowthatsfuckedup.com, a site where guys swap sexually explicit shots of their wives and girlfriends, was arrested in October at his Lakeland, Florida, home -- a raid in which Wilson was cuffed and his computer seized. Now he's out on bail and possibly facing life in prison after being hit with one of the stiffest obscenity charges in the history of the Net. But there's burgeoning doubt over which dirty pictures really landed him behind bars: the site's quotidian porn or its hundreds of graphic images, allegedly uploaded by U.S. soldiers, of dead Iraqis. There's little question that the site is disturbing. Polk County Sheriff Grady Judd calls it "so perverse and outrageous and unconscionable, I believe it would have shocked the conscience of the most liberal people in the United States." But who really engineered the arrest: local authorities or those in the highest reaches of government? To many, this case, which some liken to 2003's "flag-draped coffin" controversy, raises serious questions about the public's perception of war and the future of free speech on the Internet. "It creates the possibility for censorship . . . based on the standards of the least tolerant community," says Kurt Opsahl of the Electronic Frontier Foundation, a nonprofit digital-rights group. For Wilson, the saga started with credit-card problems. After launching the site, he began getting e-mails from soldiers who couldn't join because of bank-verification issues. So Wilson told them that if they could provide photographic proof that they were in Iraq, he'd let them on for free. At first the photos he received were benign, such as soldiers posing by their tanks and barracks. But then came the gore. One picture shows a severed head floating in a bowl of blood. Another, a dismembered arm. A particularly gruesome photo shows a child with bloody pulp where his face used to be. Though Wilson says he was shocked when he first saw the photos, he empathized with the soldiers' desire to show the realities of service. Rather than censoring the images, he created a separate forum for them, quoting a line from Life, when the magazine published war-dead photos during the Spanish Civil War: "Dead men have indeed died in vain if live men refuse to look at them." Wilson never requested photos of the dead, but news of the site soon broke with the "bodies-for-porn" sound bite. Likely fearing another Abu Ghraib, the Army launched an inquiry into whether the images constituted a felony. But the photos couldn't be verified, and Wilson fell outside military jurisdiction. Though the postings from soldiers could be a violation, says Army spokesman Paul Boyce, "we can't enforce the Uniform Code of Military Justice on civilians." The military inquiry was done. But then the cops showed up. Polk County has a history of being tough on porn, and local officials insist the pictures of war dead were not the reason for the arrest. "Our charges were not related to the notoriety brought to that Web site" by the war-dead photos, says Chip Thullberry of the local state attorney's office. But both Thullbery and Judd say that information from Wilson's arrest has been shared with the military. Given that the government took his computer, it could now identify -- and prosecute -- soldiers who e-mailed photos to the site. Boyce, however, denies knowing of a military connection to the case. "I'm not aware of any communications from [the prosecution]," he says. Given the enormity and unique nature of the charges against Wilson (previous obscenity cases against porn masters have been ruled unconstitutional or dismissed), his attorney Lawrence Walters finds the dissociation hard to believe. "There may be a political undercurrent here," he says. "To what extent was this mandated by the military using the local state attorney as a pawn?" He's not the only one raising this question. When news of the photos first broke, Arsalan Iftikhar of the Council on American-Islamic Relations sent a letter to Donald Rumsfeld demanding an investigation. Iftikhar now believes Wilson's arrest was a "politically motivated" solution. "It wouldn't surprise me," he says, "if the charges were there to deflect from the issue at hand: the violence suffered by the Iraqi people." An anonymous source, claiming Pentagon access, went further: "Once the deputy chief of staff got word, a call was made to the Florida prosecutor and the governor, who of course is related to the president. A day later, [Wilson was] arrested." Regardless of who was behind the arrest, a conviction would have a chilling effect. Obscenity, particularly online, is difficult to prove because it relies on the slippery criteria of community standards. Wilson's site, which runs on computers in Europe with content from around the world, exists in the vast online community. If his case goes to trial, a jury of Polk County spinsters could effectively regulate content for the entire planet. As Wilson awaits the outcome, the site is still up and running. Authorities said her 14-year-old daughter called the sheriff’s office to report that she had found her mother lying there and unresponsive. A team spokesman said Schoeneweis had left the team, which was playing a doubleheader in Florida on Wednesday night, and was returning to Phoenix. “At this point, anything we can do to support Scott and his family, will be our focus,” said Diamondbacks general manager Josh Byrnes, who was with the team. “I have talked to Scott Boras, the agent, a few times. We’re trying to get the facts the best we can. It’s devastating news. Everyone is taking it very hard.” The 35-year-old Schoeneweis came to the Diamondbacks last December in a deal with the New York Mets, who agreed to pay $1.6 million of his $3.6 million salary for 2009. Schoeneweis, a survivor of testicular cancer, is 45-55 with a 4.89 ERA in 11 seasons with five teams, the last two in New York. Scott and Gabrielle Dawn Schoeneweis celebrated their 10th anniversary in January. They had three children together, and she already had a daughter when they were married. “His world was just rocked. Not completely but enough for me to know he's moved out of the state he originally lived. The child support services doesn't even know where he's currently living or working at so their a dead end to me. I'm not sure who to contact in Floria to get me help or where to start looking. How Can I Go About Suing For Overdue Child Support? My birth certificate states that I have no father (it has a bunch of Xs). Through Accurint.com, I've found his social security number and address and home telephone number. He resides in Edgewater, Volusia County, FL. I reside in Buffalo, Erie County, NY. and I am a 21-year-old male university student. My mother and I have not received any child support from him at all. He left when I was born and my mother did not know his social security number, just his previous address and that he moved to the state of Florida. I believe that he will have to submit to a paternity test in order to prove that he is indeed my father. How can I go about ordering this via court? What is the next step that I need to take now that I have all this information on him? Thank you!
